Jared Hewett served in Company I, One hundred and sixteenth New York Volunteer Infantry. He and the appellant, Anngenette Hewett, were married August 7, 1887, in the State of New York.

"She filed September 22, 1893, a claim for pension as his widow...[which] was rejected July 13, 1910, on the ground that at the date of claimant's attempted marriage to the soldier, she had a living husband from whom she never was divorced....".
